PLA wins suit over art

THE People's Liberation Army's guard of honor has won an infringement
lawsuit against an artware company for unauthorized use of its images.

It is the first time the PLA has gone to court over misuse of its image,
though violations have occurred in the past.

The People's Court of Haidian District in Beijing announced yesterday
that the Chinese army's guard of honor was successful in its lawsuit
against the Shenzhen-based Xinhe Artware Co Ltd in southern Guangdong
Province.

The court said the artware company was using the images and names of the
guard of honor on its product promotion materials without authorization.

"It is the first time for the guard of honor, an image representative of
the Chinese army, to take the legal means to protect its due rights,"
said Li Dongming, a judge of the court in charge of public affairs.

"It is a sign that shows the army men are becoming increasingly aware of
the importance of the rule of law," said Li.

The PLA's guard of honor represents the image of China's three armed
services, the Navy, Infantry and Air Force, at state ceremonies or
welcoming ceremonies for foreign guests.

The court ordered the company to destroy all materials with the army
men's images and pay 100,000 yuan (US$12,379) in damages to the PLA.
